Well it seems that Google has finally been sued by a website! However, this was not due to AdWords or AdSense. This was because Google lowered the ranking of a website. As they say “Google lowered their Web Ranking in March 2005 without any warning or reason”. This was the first of a kind lawsuit against Google and we doubt that they will actually win. However, being one of a kind, we think it’s important to discuss this.
The lawsuit was filed in the U.S. District Court in San Jose, California on Friday. First of all, the website was Kinderstart.com and they are claiming that Google was an extremely profitable source of traffic to their site. Kinderstart.com claimed that they had 10 million hits a month at it’s most.
However, due to the recent decline in Google’s Search Engine Ranking, they claim that they are recieving 70% less hits and an 80% decline in their revenue. Kinderstart says that Yahoo! and MSN have them displayed at the top listings for “kinderstart”, whereas Google, the leading Search Engine provider, has lowered the ranking for Kinderstart.com when searching for the keyword “kinderstart”.
Also, they claim that once a website is penalized, it is nearly impossible to contact Google to at least find why the website was penalized. The lawsuit which was filed, also said that Kinderstart.com claimed that Google deprived them of their constitutional right of “freedom of speech”.
It seems wrong that Google is being sued for displaying results which is followed by their own algorithm. Google has made no comment yet, but we should be hearing the results!
